Legal Question in Family Law in Florida

Child support not being credited

I have the money order receipts for all the last 2001 child support payments I have made this year. The child support office is telling me iam 3 months behind and that my recipts mean nothing because that dosent mean that I paid it . Is it my respoisbilty to pay to have each one checked to see that it was cashed by them, or what happened to the money orders in questions. They can not even give me the excat months that are missing just a list of payments they have posted . If i do not pay the 450.00 they say Iam behind then my drivers license will be suspended. What can I do to correct this ?

If the problem is administrative, try to get your former wife to agree to sign an affidavit that you are current. Take it to the clerk of court. If she refuses to help, file a petition with the court to compel the correction of the record.

Re: Child support not being credited

It is not clear whether your dispute is with your former or with the Clerk's Support Division. If you paid the support to the Clerk's office but did not get credit for the payments, you will have to get proof that the money orders were cashed by the Clerk's office. In the future, insist on a receipt from the Clerk's office or pay by check so you'll have a canceled check. If you gave the money orders to your former, ask her to confirm that she received the support payments, or again you'll have to get the canceled money orders to confirm payment. Basically, you have a problem of proof; with money orders it can be a problem but the proof is with the issuer of the money order but getting it can be difficult.
