Can I get custody of my son if his mother is on welfare and makes no income?

It would really depend on all the circumstances. Just because she is on welfare does not make her a bad mom. Are you paying your child support?

Hello; The first response is correct, her financial status is only one of several factors the Court will consider in a custiody case. You may also attempt to get more time (such as half of the month) which will mean the child support should be reduced.
