Legal Question in Family Law in Florida

Dad's chances

I'd like to know what the chances are that a judge would grant me custody of my 2 kids, in my home, and have their mother find another place? She has been screeming divorce for about 2 weeks, and becasue I'm hurt, I want to talk about it, and at first, work it out. Now I'm just focused on the fact that the discussions have always included me finding a place. Her parents are wealthy and live 5 min from the house, she could stay there, save us a ton, and see the kids whenever. What are the chances?

Re: Dad's chances

Depends on particular facts of your case. FL courts are courts of equity and balance all factors when deciding, there are no guarantees. Court uses best interest of the child standard. Parent who spends most time caring for children, is likely to have a strong argument for custody.
