Legal Question in Family Law in Florida

Divorce in Florida

My husband and I agreed to divorce

and he filed. We have decided to go

to marriage counseling in the past

month since he filed. I now have to

respond to the petition for divorce.

I want to contest the dissolution in

light of our new decision to try

counseling, which begins tomorrow.

I also have to contest the petition

because he filled the parenting form

out incorrectly.

i have the form to counterpetition,

but this states that I want a divorce,

but want to change some

things...when what i want is a few

months to try counseling. In the case

that the counseling is a bust, then I

have a few things to change to the

original petition. But ultimately, I do

not think our differences are

irreconcilable.

What do I file? I have one week from

today to file me response.

Re: Divorce in Florida

File a motion to extend time to file answer and a motion to abate your divorce for 90 days to allow time for counseling. Most judges are pretty reasonable about allowing time for couples to try to save the marriage.
