I have a home for sale in Virginia, and I was married in Volusia County in Florida in 1995. I am now residing back in Florida. Can I proceed with the filing here in Florida? I moved away in 2005.

How long have you been back in Florida? You have to be a resident of Florida for six months before filing the petition. If you left and moved to Virginia as your home, then the six months begins again when you return. If you file before then, the case can be dismissed and you lose the filing fee and other court costs that were paid.
