Divorce

I'm been married for 13 months now. During this time my husband became verbally abusive. We have no property together and both cars are soley under my name. We have no children. He won't sign divorse papers. Can I file without him signing and do I need to get an attorney to help me do this?

You can file for divorce against the wishes of your spouse. The only papers both of you are required to sign would be either for a Simplified Divorce or a Marital Settlement Agreement.

You are always better off with a lawyer, but you may be able to represent yourself in a divorce with rather straight forward facts. I would go to the Clerk of Courts and determine if they have pro se'packets for Dissolution of Marriage. These packets should have all of the legal papers needed to file a Divorce. You may want to begin the papers and then consult with an attorney. For a modest fee, many attorneys' will review the papers and provide you with pointers.
