File break order

My husband, NCP, was told to file a break order after mom refused to allow daughter to come for Thanksgiving visitation although order states dad gets entire holiday on all odd numbered years. Deputies told him to file a break order but we can't find any info about it or how to file it.

Never heard the term. Maybe file criminal contempt.

I assume the deputies mean a "motion for visitation over the holiday break" or something like that. You would have had to have scheduled that a few days ago and put it on a judge's emergency holiday calendar, if your county has a judge who was going that.

If your husband doesn't get to see his daughter this weekend, he should file a motion for contempt and ask for extra time over the winter break. If this sort of thing happens a lot, he should file a petition to change custody.
