How To File For Visitation To See My Son

The Dept Of Revenue has been garnishing my check since 2002 for child support payments for my son. My son's mother and I were never married, just boyfriend and girlfriend. Since the garnishment took place in 2002, I was under the impression that I would get a scehdule of visitation with my son, I have not. I therefore have to go with when my ex-girlfriend feels like letting me see him which is very rare, like once every other month. I cannot afford attorney, because I work a minimal wage job. I am trying to do the right thing, and in turn I feel like I am getting screwed. I was going to try to file what papers I need with the courts but I am confused. I was told to file a modification of child support, and then I was told it would not be a modification because there was never an order for visitation in the first place, that I would have to file a paternity case. I don't understand why I would have to file this if my name is on the birth certificate? Please someone help me. A Confused Father Who Just Wants To Be Part Of His Son's Life.

1. If your wages are being garnished, there must be an order.

2. Seek visitation from the court. The self help department has forms to use. Good luck.

if you are in dade county you can contact self-help for more info. In broward county you need to get a paternity packet which is on the second floor of the court house. In Palm Beach check with the clerk of court. Good luck. It is not so difficult but you will file a paternity packet and the process is not very difficult or expensive so hang in there and your right to visitation will be heard by the courts
