Legal Question in Family Law in Florida

I am a grandparent. My son is in jail and he was never married to his girlfriend but he is listed on the birth certificate. She will not let me see my granddaughter since my son went away. Do I have any rights to see my granddaughter? I have tried to call her and have written her as I was babysitting her every other weekend and because her and my son no longer have a relationship shouldn't mean my granddaughters family goes away. My son will have rights when he gets out in a year and why not just have things already flowing. Can I do anything? I hate to have the expense of a lawyer and I know she can't afford it. Any advise on what I should do. Thanks Michele Ward

Unfortunately, Florida has no grandparents' rights law. (Well, it has one, but it's been declared unconstitutional.) So, the law is that you only get as much visitation as the parents say you get. And if she is saying you get no visitation, then you get no visitation. You'll have to wait to get visitation through your son.
