Legal Question in Family Law in Florida

Gurdian vs Father

My husband allowed his aunt to have gurdianship over his baby 15 years ago in the agreement that the aunt would adpt the child. The aunt never adopted the child, now the child is 15 years and the aunt is filing for child support from the father. The father was not allowed into the childs life for the first 13 years until the child was informed of the trust of who her father was. The second part is the child has been in A LOT of trouble, running away every other week, drugs, DCF has been involved in accusations of abuse fromt he aunt but nothing done. The child is currently on the streets and is refusing to come back to the aunts house. The father wants the child to come live with him and the child wants the same. Can the father go pick up the child and take her to his house without approval of the Gurdian aunt? The court defines the father as having full custody even tho the aunt has gurdianship.

Re: Gurdian vs Father

Yes, the father can just go get the child (and it sounds like he should), but my hunch is that the father can expect an immediate action to terminate his rights filed by the aunt.
