Legal Question in Family Law in Florida

Me and my husband were separated but not legally separated,and he passed away just a couple weeks ago,his brother is trying to take his truck.What i want to know is if we are still legally married,does the truck belong to me and my kids?

It is part of your husband's estate. You will need to be appointed personal representative of the estate and change title.
