Legal Question in Family Law in Florida

Can I get joint custody of my son, meaning every other week, until he is of school age? My ex and I were never married, she's pushing for me to see him only every other weekend and only one day visitation during the week I don't get him. I've heard of it being done recently but I don't know how to look it up.

Has paternity been established through the court? If not, your best bet is to file a Petition to Determine Paternity and for Related Relief (Florida Supreme Court Approved Family Law Form 12.983(A).)

As part of this process, you and your ex can attempt to work out a time-sharing schedule that is good for both you and your son.

If you were never married you need to file a Petition to Determine Paternity Time Sharing and Support. You can then outline the time sharing (visitation) you want and why. The court will put in place a schedule that is in the best interest of the child. Several considerations will be weighed including but not limited to: the distance away that you reside from the Mother of the child, the age of the child, his current schedule, your current time sharing, the needs of the child.
