Legal Question in Family Law in Florida

Keeping house after divorce.

I am in the process of getting divorced. I have been married 8 yrs. I have one child, 16 yrs. old. He is not the biological father. He owned the land, we had a house built on it. Can I put in the divorce decree to stay in the house until my child turns 21? Does his name have to be taken off the mortage? I do not want to refinance. Thanks!

Re: Keeping house after divorce.

You better see an attorney on this one since there are issues here that may be to complicated to handle on your own. For example, you should request in your petition, exclusive use and possession of the home, the home is a marital asset, must plead that. If you have any further questions feel free to contact my office. (954) 966-4140 Sincerely, Melody Stickel-Martinez, Esq.
