if theres no legal binding contract can my sons father decide to not give him back to me wihout any consquences?

If the Court previously addressed custody, take him back before the Court on a Motion For Enforcement/Show Cause (Contempt).

If the courts have never been involved, then it is time to have a Judge/Magistrate address custody and child support.
