what legal rights in florida do i have to my house if the loan is solely in my name, but my wife is on the deed to the house.

Background information: She has continued to live in the house since separation in August 2014. I was paying the mortgage as the child support payment until she placed me on child support through the DEPT. Of Rev. and i was required to pay them, since that order she has not made a mortgage payment.

What do i file or do to gain back this property and remove her from it. There has been no divorce started through the courts yet.

The house is presumed to be a marital asset so you get half the value. Start a divorce case to have it sold.
