Legal Question in Family Law in Florida

I married in 1968 and separated in 1974. My first husband had divorce papers written up, I paid half to have them filed and was told it would be final in 6 months. I remarried a year later and divorced 5 years later.. In 1980 I married my present husband. While getting together papers needed to file for S.S. I realized I had no divorce decree from my first marriage. I have since found out my x never filed it. I am terrified and am wondering if this is fixable. My husband of 31 years says he will help me do whatever we need to do, but I feel like my life is ruined. I live in Florida..please help!

This is something that is fixable although it will be time-consuming. I do not want to scare you, but your first husband has put you in a position of being a bigamist due to marrying while you were still married to him. I have a few questions before I can determine if and how I might help you. Is your 1st husband still alive? Does he live in Florida? Please contact my office at 904-371-3538 or email me at [email protected] for a free consultation.

This is not the end of the world. You need to locate your first husband. If he is stll alive, see if he will cooperate in having a Simplified Dissolution of Marriage done. As long as he cooperates, and is willing to go to the Courthouse with you, you probably won't even need to retain an attorney. If he is deceased, if he died before you married your present husband, then you are good to go. If he died after, then all you will need to do is to remarry your present husband.

The above information is provided without any consideration/payment having been received, and without full knowledge of all of the facts.

An internet inquiry is no substitution for an in-office consultation with an attorney.

If your situation falls within the Greater Tampa Bay area, I would be happy to schedule you for a no obligation half hour office consultation. The main office is in Dunedin, with a satellite location in Tampa.

Feel free to Google me.
