Legal Question in Family Law in Florida

Modification of an order

My ex husband, who is in contempt for non-payment, has attempted to reduce his child support 3 times, unsuccessfully. He has now filed a 4th motion to reduce support but this time he filed a Motion to modify the Order. How do I stop him from these frivolous filings? When does the court finally impose some serious consequences?

Re: Modification of an order

The Court has significant authority and power to prevent your ex-husband from abusing the legal system. First and foremost, the court can enforce its own orders with its power to hold your husband in contempt. Second, you can file a motion on notice under section 57.105 to have the court sanction your ex-husband for his frivilous filings. You can obtain an order from the court preventing him from future frivilous filings and get your legal fees paid by him under section 57.105.
