Legal Question in Family Law in Florida

Moving to another state. Divorce not filed yet

I am in the process of relocating to Florida for a new job with my daughter. Can I file the divorce in FL even though I was married in NJ? Also, what if my husband files before I leave? Do I have to stay in the NJ until the divorce is finalized or can we continue the process while I'm in FL?

Any advice is greatly appreciated.

Thank you,

Dolores

Re: Moving to another state. Divorce not filed yet

Thank you for your inquiry.

Based upon the facts presented, I believe that you need to file for Divorce in the state of New Jersey. I do not believe that Florida will have jurisdiction.

As it would be my pleasure to speak to you regarding your situation, please feel free to contact my office at 732 246 0909 to discuss same.

Very truly yours,
