Legal Question in Family Law in Florida

seperation and minor child custody in florida

I am separating from my husband. He is the biological father of one minor child and I am pregnant with a second child. I need to know if I can move a significant distance away with my child or whether this would be considered parental kidnapping. I will remain in the state of Florida but six hours away from current residence.

Once a divorce or separation is filed, you can move the child (and the newborn once you give birth) no more than 50 miles from where you live now. Technically, you are allowed to move until something is filed, but many judges will make you move back or change custody once the divorce or separation is filed.
