What states do not require a background or waiting period check for marriage?

I don't know of any state that has a background check requirement, but almost all states have a waiting period before you can get married in that state, including Florida (the other lawyer who answered your question is mistaken). Florida, however, waives its waiting period if you take a premarital class.
