Legal Question in Civil Litigation in Florida

defamation of character

Can I sue someone if they said I was a prostitute and a whore? I am an honest law abiding citizen and someone made these comments which are totally false and I would like to do something about it, but I'm not sure if any law applies to that. Thank You.

You may have a claim based on the legal theory or cause of action of slander, but even if you do, your problem will be proving how you were financially damaged by such alleged slander. Also, if you were to file a civil action based on alleged slander, the defendant would be allowed to ask you questions, under oath, of a very personal nature and investigate your personal life to learn whether or not any unsavory facts about your sexual history exist. It can become a very unpleasant experience. Litigation can at times be a very nasty business for the litigants. Be careful, proceed with caution, consult a lawyer and good luck.

In addition to the reply by Peter Gonzalez, you the comment would need to have been communicated to a third party. In other words, if you were the only person in the room and no one else heard the comment, you won't prevail in your lawsuit. Lastly, the third party hearing the comment must reasonably believe that the comment was true.
