Legal Question in Civil Litigation in Florida

mobile home repo

Last November, I "sold" my mobile home. Because the buyers had poor credit, I agreed that I would keep my existing loan with my finance company. The buyers agreed to pay me $200 a month (my monthly pymt) and also pay for the lot rent and insurance. In February the started making only partial pymts, now they are paying nothing. How can I get them out. I tried to post a pay rent or quit notice, but their lawyer says this is not a landlord/tenant situation. I know I made a bad deal. They have so much as told me they will try to live in the home without paying for as long as possible. What can I do? Can I forclose on my mobile home, when I don't hold the mortgage or the land?

Re: mobile home repo

The answer to your question really depends on the nature of the agreements you made with the "buyers." It may very well be a landlord/tenant situation. Based only on the facts you have given, it is not clear that it is not a landlord/tenant situation, contrary to what the "buyer"'s attorney stated. You would need to bring all the written agreements, deeds, bills of sale, and any other documentation to an attorney in order to get the proper advice on how to proceed. You certainly have legal rights here, but more information and analysis is needed to determine the correct way to proceed.
