Legal Question in Civil Litigation in Florida

Help - tire company damaged rims - What do I do

I had two tires replaced. Tire man used a defective tool to change tires which scratched kinda deep and all the way around rims. They turned over to their ins comp. which told me upfront to get two est. and they would pay lowest one. I sent two est. Being a ford with factory rims I wanted same kind and same brand "Ford". Now, they want me to get same type but an after market brand which is about half price and offered me $300. less than the two est.

Do I have to take offer?

No, you don't have to accept their offer. On the

other hand they don't have to offer anything. If you

do not reach an agreement, your remedy is to file

suit in court. Your damages are what the value of

the tires and rims were, not the cost of new ones.

The judge or jury would make that determination

based on the evidence submitted.
