Legal Question in Civil Litigation in Florida

tire purchase then defective

i purchased a set of used tired from a local tire shop and they insisted they were good but 2 days later on the highway one of them flew apart and as the tread flew off, it damaged my car very badly not to mention the fact that the tread may have hit another car in the process. it flew off as if it were a re tread but im not sure if that is the fact.

my question is does the tire shop have any legal liability toward this incident at all or am i just gonna have to eat all these costs?

It really depends on the language in any contract you may have signed. However, regardless of the contents of the contract, there are certain provisions which are always read into a contract, including a guarantee that any product be fit for the use for which it was sold.

Re: tire purchase then defective

It depends on the terms of sale and just how "used" they were.
