Legal Question in Employment Law in Florida

Earned Vacation Time

I just earned 2 weeks vacation time on 5/13/07 and was terminated from my job on 5/22/07. Does my former employer have to pay out my earned vacation time, and how long do they have untill they have to give me my last paycheck.

Re: Earned Vacation Time

If you are an employee (as opposed to an independent contractor) there is no time requirement for an employer to provide the final paycheck under Florida law (ridiculous isn't it? - Complain to your state legislators - that's the only way this nonsense will change). I have obtained vacation pay for several clients in the past. There is some legal authority that your vacation time should be paid out. Some attorneys will take these cases on contingency because if you win the judge may make the employer pay the attorney fees and costs. If you can't find an attorney to take the case, file your own small claims court action.
