Legal Question in Employment Law in Florida

Can I be fired for taking vacation?

i work at a university, and have planned a vacation for almost a year. I just got a new supervisor and have been telling the people that I would be taking the time off the last part of Aug, beginning of Sept. I already have money down on this as they know and now they tell me that I can not have the time off and if I take it that I will not have a job to come back pretty much. My question is if I go out under a doctors note for that time could they do anything to me?

Re: Can I be fired for taking vacation?

The timing of an employee's use of vacation benefits is generally a management perrogative. If your request for Medical leave is legitimate, they are required to provide it to you with pay, provided those benefits have been accrued. However, if you are to be out more than a couple of days, and they believe an illness is not legitimate, they can do the following:

1. Requiring you to provide more detailed medical information.

2. Require you to be examined by one of their physicians.

3. Place you under surveillance.

Needless to say, you could be terminated for cause if the illness is determined to be a ruse to obtain vacation leave.
