Legal Question in Employment Law in Florida

Forced out of job

I have been working at my job for over a year. In that year I have been repeatedly harrassed by a coworker on the unit I work on. I have repeatedly gone to my nurse manager for this problem without any satisfaction so I finally went over her head to human resources and filed a 3 page complaint detailing the harassment I have endured due to this employee. I might add that she also harasses other people on the unit as well. After I went to Human Resources I was basically blacklisted on the unit and eventually was accused of ''having an attitude.'' I never had any problems when this particular person and her cohorts weren't working. Also another male coworker also had gone to Human Resources for the same employee and he is also getting alot of flack for it. They are writing him up for bogus things and are now threatening to fire him when he is the best worker there. I feel this is a definite reprisal for going to Human Resources. I have now been forced out of my job and informed I have to now work at another hospital due to the conflicting personalities on the unit. I feel that I'm being railroaded as if I'm good enough to continue to work for the company then why can't I continue in my present job. Do I have any recourse?

Re: Forced out of job

Unfortunately, it would seem that because the issue you complained about itself may not be illegal (a supervisor who treats everyone poorly may be rude, but is not violating the law), you may not have a claim even though they might have "retaliated" against you for complaining. This is a very fact specific situation, so it is important that you consult with an attorney. It also may be the case that you were not paid all of your overtime wages or other benefits you may be entitled to under the law. Please feel free to contact us for further assistance.
