Legal Question in Landlord & Tenant Law in Florida

On 11-16-2009 code enforcement was called to come to the house several pictures were taken. The landlord was contacted and has 30 days to clean up and fix the apartment. I don't know what the landlord has intentions of doing after the repairs are done. I don't want to give him Dec. rent until all repairs are done.

What can happen if I don't pay Dec. rent until everything is done? Also can he evict us?

Lesly Longa Longa Law P.A.

If your apartment is not up to code, your landlord has a duty to make repairs and comply. You may be able to withhold rent, but you have to provide notice to the landlord as required in Section 83.56 (1), of the Florida Statutes.
