landlord tenent rights

my lease is up on may 1st. 2009 the landlord has last month and a month security$ 2,600 we are currently still owe$ 800on feb. and $1300for march which we are making weekly payments of $400 how many days notice must be given to us on if he intends on renewing the lease or wants us to vacate?please advise me of how to handel this legally tofind out how long he has i have a 18month old child and dont want to become homeless

If your lease doesn't say, then you're out when it ends. If you pay the May rent and your landlord accepts the money, your lease continues month-to-month until either of you gives notice to vacate at least 15 days before the start of the next month.

renewal rights and notice information can be found, almost always, in your written lease. Star there. 30 days notice in generally what is required. You have it a little backwards, probably. The lease usually gives you the right to renew, assuming that you give the correct notice. If there is no right of rebewal, then when the lease ends, it ends and you must vacate -- even if there is no notice.
