Purchasing Property with Tenants

If I purchase property that has tenants that are currently renting, what concerns do I have? I told them they could stay there, but can I make them sign a rental agreement if I do not own the property yet? I do not want wait until closing to find out they refused to sign the Landlord & Tenants agreement.

You should review the existing agreement to find out if it is assignable. If it is, you may be subject to the old lease if not the sale of the property may terminate the old lease and you may require the tenants to vacate or sign a new lease.

You can require the previous owner to end the current lease under its termination clause. Then, you can negotiate your own agreement with the tenants. I am available to consult with you on how to do both.
