Legal Question in Personal Injury in Florida

I was in a car accident a couple weeks ago, and I do not have insurance. Florida is a no fault state, but they said I pulled out into the middle lane which was BS, and I was side swiped on the driver side. On another note, I am in the middle of a Chapter 7 BK proceeding. I received a letter from a Personal Injury lawyer, and it has barely been a week. Does my Chapter 7 BK protect me at all? She was in an SUV, and mine a Toyota...I am gonna have the biggest bill...she make have to pop out a dent and some new paint. Well let me know..

I'm sorry to hear about your accident. If you were injured in the accident and you want to make a claim against the other driver, then the bankruptcy trustee has the right to take over your claim and settle it, and you will probably not get any recovery from the claim.

If the other driver makes a claim against you, then your bankruptcy may protect you, but you would have to amend the bankruptcy schedules as soon as possible.

The relationship between the injury claim and the bankruptcy is complicated. We handle a lot of injury claims and bankruptcy cases. Our office is in Palm Beach County and we offer a free consultation. We would be happy to speak with you about these matters if you would give us a call.
