NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

You need to have the will read and reviewed. If the bequest was to your husband, then it should go to him. If it was left to your husband's children, then it goes to them. This is all controlled by what the will actually says. If you cannot obtain a copy of the will from your husband's brother, then request one from the court and have it reviewed by an attorney who can advise you as to what it states.

Re: my husbands step father died

The distribution of assets will be specifically stated in the will. It is very normal for assets that were suppose to go to a father or mother to pass to their children, and not a spouse in your described scenario.

However, if you are concerned that the distribution is not being handled properly and/or you just want to insure your rights as well as those of your deceased husband and his children, you should request a copy of the will and have it reviewed by a qualified attorney.

Good Luck and if we can be of any assistance to you please feel free to contact us directly.
