Kicked How can I Collect?

About 3 years ago my husband was kicked in the knee at a resturant. He suffered with having surgery and pins put in his leg. The pain often interfers with his work. we did obtain an attorney and just today he told us we will have to settle for $3,000 and that was all we can get. The man who kicked my husband is a vietnam vet and lives with his mother on disability and social security. Our lawyer said we couldn't get anything from him because we can't touch government money. The owner of the resturaunt owes $250,000 to the government so we were once again told we can't collect from him either. now his business went under. the insurance company said that he didn't have insurance at the time of the accident. Even now with his insurance he doesn't have coverage for the specific accident that is in question. But their giving us $3,000 to release them from the law suit. So what can we do? Can we sue the vet? The resturaunt owner? we were told we could sue the owner and win but we would never see the money because he has to pay off the government first. Should we seek a new lawyer or is this one right? Thank You,

When faced with bad information I always recommend getting a second opinion. If your present counsel is legitimate he will not object to someone else taking a look
