Legal Question in Personal Injury in Florida

personal injury

I DID not like the settlement my lawyer proposed, therefore I DID NOT sign the release form. My question is can I sue the at fault party in civil court? I found out that this person may own a business. The settlement offer does not cover much at all. There is also a possibility I might need surgery along w/$1500-$1900 of medical attention a year. I feel like it's Not my responsibility, that's why I did not sign ANYTHING. I was wondering do I have a good case? I realize anything goes in the court room, but I am wiiling to risk what I know in my heart I deserve.

Re: personal injury

You have a right to reject a settlement offer. However, make sure it is an offer and not an agreement, because if it is an agreement, you may be forced to accept it.

Nevertheless, it is impossible to know what the value of your case is without knowing the liability is and what damages you sustained. If your attorney is experience in this area of law, you should sit down with him or her and discuss why they feel you should settle. They know what the cases settle for, what the jury verdicts are, and the cost effectiveness of trial vs settlement.

If necessary, pay for a consult with another attorney to see what he or she thinks.

Good luck!
