Legal Question in Personal Injury in Florida

who is responsible for damage to a golf cart on a public course. paid green fees with cart, played 18 holes, drove around a corner of cart path and ran into a tree next to cart path. cart was damaged.

nothing was signed to say who is liable for cart.
