Legal Question in Personal Injury in Florida

What are his rights?

My brother has been in prison in AZ for 11 yrs. His wife moved to FL and 2 years ago was involved in a car wreck. She is settling for $1 million. Apparently she told her lawyer that my brother was in the process of divorcing her and she used her maiden name when she filed the law suit. The courts want to see the divorce papers and she is begging my brother to divorce her so she won't get in trouble saying that they can get married again later once she gets her settlement. I know that Arizona is a community property state and that is where they were living before he went to prison. He doesn't want to divorce her and she didn't want a divorce until all this settlement stuff came up. What are my brother's rights to part of this settlement and do you think she is trying to scam my brother or her lawyer and the courts?

Yeah, sounds like she is after the money. Being married in that situation means what's her's is his. Contact the lawyer that the first lawyer referred or call me. I will get you an attorney for your brother that is good.
