It depends. Generally, the start of meaningful negotiations should start at the time you have completed the medical treatment. Your lawyer should have told you this at the beginning of the attorney client relationship. also, the lawsuit must be filed within four years of the date of the accident. You should probably speak with your attorney to see what reasons he or she has. They may be waiting for you to finish treatment, or they may be trying to negotiate a settlement out of court. Since you will probably pay less in fees if they settle before filing suit (check your fee agreement), it's in your best interests to let them go ahead and try to negotiate a settlement, but you should be kept informed of what is going on. It depends on the facts. There are often good reasons to delay commencement of the case. Ask the lawyer what his plans are and what the timetable is and why. If the answers do not make sense or you have lost confidence in your lawyer it is easier to change earlier rather than later.
