I am submitting a formal offer on a second home. The property was purchased through for foreclosure and the seller stated that there were no known defects or problems and the property is being sold as is. The property went under contract and fell through after an inspection showed problems with the roof, chimney and irrigation system. Can the sell still state to me that there are no known defects or problems? Can I use the information from the home inspection as a bargaining chip on the property?
