Legal Question in Real Estate Law in Florida

Deposition Requirement

Does the defendant have to right to delay a deposition? The defendant was notified Jan 20 for a Mar 11 deposition, now the lawyers are trying to delay. Can I make them keep the date?

Re: Deposition Requirement

You'd have to have a pretty good reason to force that date on them before a judge would agree with you that the date would have to stick. A ggod reason would be something like, "one of the witnesses only has a short time to live, and if we don't take the deposition soon...." The other good reason is that delaying the deposition will delay the trial. Judges often don't like trial delays after the trial date has been set.
