Legal Question in Real Estate Law in Florida

Lease Expired, is rent still the same as lease terms

My lease expired in January 2007, It was $500.00 a month. I starting paying more toward the rent because I was making overtime at my job. It is now June 30th and I will be giving my landlord a 15 day notice. I am now on month to month. I never got a new lease. Since I paid $1400.00 extra toward rent do I have a right to request that money back? Since my lease expired at $500.00 rent and I had nothing else in writing, the month to month rent would be $500.00, Correct?

Not necessarily. If your lease expired and you remained in the premises, the landlord may have considered you a holdover tenant and be entitled to an increased monthly rent pursuant to Florida statutes. By paying the additional monies, your landlord may have considered it your acquiescience with the increased rent as a holdover tenant.

unless he requested an increase, your rent is still $500. If you chose to pay him more, I doubt you can get it back
