Legal Question in Real Estate Law in Florida

Listing agent refuses to accept FHA loan or sell any properties

Listing agent handling 90% of properties in selected

neighborhood. She is demanding no FHA loans - $ 5,000 non-

refundable escrow and right to decline up to closing!

She claims homes will not pass FHA inspections but provides no

documentation to support this.

What can we do to purchase a home in this area?

Re: Listing agent refuses to accept FHA loan or sell any properties

The listing agent does not have the right to dictate such terms. The agent has a duty to present the offer to the sellers. You certainly are not obligated to work through the agent as a buyer, and may be able to contact a seller directly without the agent in between. The seller would still have a contractual obligation to the agent for commissions, but that is not your issue. The owner of the home is a matter of public record. Good luck.
