Legal Question in Real Estate Law in Florida

Partition of residual house

After Florida probate, my step-son owes 25% of house and I own 75%. He lives in it and refuses to discuss any offers to buy me out or for me to buy him out. I merely want/need my 75% and get on with my life. What legal options are available?

You can file a suit for partition. The court will usually allow one party to offer to buy the other out and failing such, then require it be sold on the open market at the best price to a bonafide purchaser for value. If not offers, then the property would be sold at a judicial or forced sale. The proceeds would be shared according to the ownership interests of each party.
