Re: consent to sex

This is a posting I submitted on a similar question:

The statutes, which are found at FS (Florida statutes) 743.01, 794.5 and 800.4 - see www.leg.state.fl.us/Statutes, are concerned with sexual conduct and seek to protect underage people from being taken advantage of by older people. The statutes say that:

- if a person is 24 or older, the partner must be 18 or older

- if a person is under 24, the partner must be at least 16

- sex and all sexual conduct is prohibited with persons under 16

- exception: if the underage person was or is married, then age is no longer a factor

- exception: if the two partners are married, age is not a factor

As with all sexual relationships, both partners should be physically and emotionally prepared for such a relationship and of course should practice safe sex.
