accident

i hit a vehicle parked on the right hand shoulder, west bound lanes. it was ''red tagged''. received a ticket for careless driving. filed a written defense. was found guilty. my CDL is in danger. wish to appeal conviction.

Hello: In order to help, I would need to know what county your citation was from. The next step would be to contact their traffic clerk's dept. and inquire of their policies in regard to traffic hearings. I would also ascertain the judge's name.

The goal would be to seek to set aside the ruling if at all possible. I've been doing the cases for years, no one has ever asked to appeal a traffic ticket, so I'm not sure if that is even a viable alternative. That is why I would try to ask this judge to overturn the conviction. Time is of the essence either way. It hurts your chances the longer you wait. If you are going to try to appeal the ruling to a higher court (assuming that is possible), there are always time limitations to file a Notice of Appeal, which is usually thirty days.
