Legal Question in Traffic Law in Florida

Was written a $116 citation in Florida for violation of 316-211(2). No eye protection while riding. I cant figure out from 318.18 how they can charge $116 when sub section 7 of 316-211 says it is punishable as a non moving violation? Is the citation over charged? What are my options?

The state does not overcharge, but they do charge a lot and frequently. I'm sorry, but unless by some miracle you can prove you were wearing eye protection, you would have to plead guilty. I WOULD show up to court and maybe the judge can cut you a little bit of a break. I'm not sure if the judge can. You can ask the judge is he/she can reduce the fine. They will either say no, or no, I cannot. Sometimes they really cannot. This is the first I have heard of a eye-protection citation.
