Legal Question in Wills and Trusts in Florida

My brother passed away and as his sister what right s to I have to visit him at the cemtery . Do I have the right to put flowers . Could his wife for bid me from doing that or visiting him. She has left me notes on my father grave wish is next to my brothers with nasty comments.

I dont think she can prevent you from visiting the gravesite. How would she know when you are going to stop you? The facility does not have armed guards that ask you where you are going and seek permission. I think you are safe to go. I would obviously not go on dates which are possibly dates when the wife may be there.

I don't believe she can forbid you to visit the grave site as this is a public place and not monitored and would not be considered trespassing in any sense of the word. I would save her notes however and have an attorney address her on that issue as this is a form of libel (statements generally written) and could be slander is she is relaying this type of defamation to others in the family to cause them to oust you in any manner.
