Legal Question in Wills and Trusts in Florida

I have two brothers on SS/dis. that live in my parents seperate properties with their families.My father passed last year and mother is 75 she has a living will that everything will be split in 3.Is it going to be a prblem to sell propertie with brothers in them sa their homestead even though they pay nothing?

The properties belong to the estate. The fact that they do not pay rent does not give them homestead status. However, when your mother dies, you will have to probate the estate making a determination of how much of the advanced inheritance they have received since they are living on properties belonging to the estate. A living will / do you mean a trust?
