Legal Question in Wills and Trusts in Florida

Creditor Notification

I have a friend whose wife recently passed away and left approximatley $30K in unpaid hosital bills from her last illness. A few days after she died, a long standing personal injury case that was filed on behalf of herself and her husband was settled for $50K. There is no will. Is the hospital required to be notified of the settlement of the litigation or do those monies now belong solely to the surviving husband?

Thank you.

Thank you.

Re: Creditor Notification

The portion of the settlement that would have belonged to your friend's wife now belongs to her estate. The last illness bills will come out of her total estate as the creditors get paid during the probate process.
