Legal Question in Wills and Trusts in Florida

My father passed away in April 2009, and left no will. Does my step mom have more rights to his estate than I do, his only child (21yrs unmarried)? He was in Florida. I am in California. Estate is still being administered and she is asking for Family Allowance of $18k for living expenses. If I do this am I compromising my settlement portion?
