Legal Question in Wills and Trusts in Florida

My mother put her house in a living trust and named herself as trustee. She passed away without naming a successor trustee. The trust states that the trustee will distribute the assests between my siblings are named and I. What can we do?

I suggest you file a probate and have one of your named the personal representative - then have the property disbursed according to the trust. I would speculate that she had a will prepared which refers to the trust and you can follow that for your instructions. Please be aware that probate requires an attorney. If I can be of assistance please contact my office for an appointment. 904-997-1031

If no successor trustee was named, the estate must go to probate.
